Retrospective building approval in Queensland: existing structures

An existing shed, carport, patio, retaining wall or extension may have been built without approval—or under an approval that was never finalised. Resolving it usually takes more than a single engineering inspection.

A practical pathway coordinates the property records, a private building certifier, structural assessment, any required opening-up work, rectification design, construction evidence and final inspections. Starting in the correct order can reduce duplicated work and avoid paying for documentation that the certifier cannot use.

Approval status
First confirm whether an approval exists, is still in effect or has lapsed.

Engineering evidence
The visible structure, concealed connections, footings and site conditions all matter.

Final certification
The engineer and building certifier have different roles and issue different certificates.

  1. Confirm the approval history before commissioning design work

Start with a building and plumbing records search through the relevant council. The records may show that the structure:

• is already approved and finalised;
• has an approval that is still current but has outstanding inspections;
• has an approval that has lapsed; or
• has no identifiable building approval. The distinction matters. In the City of Moreton Bay, Council advises that an approval may be finalised provided it is still in effect. If the approval has lapsed, an entirely new approval from a private building certifier is required. Requirements and processes may vary between local government areas, so the relevant council and private certifier should be consulted. The certifier should review the records and confirm the pathway before detailed engineering work begins.

  1. Engage a private building certifier early

The private building certifier is the assessment manager for the building application. The certifier determines the required application material, applicable inspection stages, referrals and evidence needed before a final certificate can be issued.

For an existing structure, the certifier may request a measured site plan, architectural or structural drawings, an engineering assessment, evidence of footing and connection details, a cadastral survey, planning or siting referrals, and certificates from competent persons or licensed trades. Retaining walls may also require reliable levels, retained heights, drainage details and information about nearby buildings, boundaries, fences and surcharge loads. An engineer can assess and design the structure, but the engineer does not replace the building certifier or approve the development application.

  1. Complete a targeted structural inspection

The engineering inspection records the structure as it exists. For a shed, carport, patio or retaining wall this commonly includes:

• overall dimensions, roof form and member layout;
• posts, beams, rafters, bracing and tie-downs;
• connections to the dwelling or another structure;
• corrosion, decay, deformation, cracking or movement;
• footing locations and the available evidence of footing size;
• proximity to boundaries, other buildings, retaining walls and services; and
• the site wind classification and exposure.

For retaining walls, the inspection should also record wall type, retained height, visible footing or post details, drainage provisions, signs of rotation or movement, adjacent ground levels, fences above the wall and any driveway, building or other surcharge near the wall. The inspection should also record its limitations. A finished structure often conceals reinforcement, embedment depth, welds, bolts, footing dimensions and other critical details. A visual inspection alone cannot verify concealed work.

  1. Allow for opening-up, testing or survey information

Additional evidence may be needed before an engineer can reach a defensible conclusion. This can include exploratory excavation beside selected footings, removal of small linings or flashings, measurement of fasteners, material testing, a feature and level survey, a boundary identification survey, geotechnical information or original manufacturer documentation. The extent of investigation should be agreed with the engineer and certifier. Opening-up work needs to be performed safely and reinstated correctly.

  1. Assess the structure and design any rectification

For sheds, patios and carports, the engineering assessment considers the complete load path—from the roof sheeting and framing through the beams, bracing, posts, connections and footings into the ground. Wind uplift and lateral loads can govern lightweight structures, particularly on exposed or cyclonic sites.

For retaining walls, the assessment considers soil pressure, groundwater and drainage, footing or post capacity, global stability, surcharge loads and any wind load transferred from a fence above. Boundary setbacks, wall and fence height, nearby council assets and applicable siting requirements may also affect the approval pathway.

Where the available evidence does not demonstrate adequate performance, the engineer may prepare a rectification design. Typical measures can include additional tie-downs, upgraded connections, new bracing, strengthened beams or posts, footing enlargement, corrosion repairs, improved wall drainage, anchors or buttressing, partial reconstruction, or separation from an inadequately supported adjoining structure. The required solution is site-specific. The existing structure should not be described as compliant until the nominated investigation, rectification and inspection work has been completed.

  1. Prepare and lodge the building approval package

The private certifier will confirm the final submission requirements. A package for an existing structure may include:

• DA Form 2 and the certifier’s application documents;
• a site plan, floor plan, elevations and sections;
• structural drawings and calculations;
• Form 15 for a certified building design or specification, where applicable;
• survey, planning, siting or infrastructure referral material;
• the proposed rectification scope; and
• an inspection schedule agreed with the certifier.

If the structure does not meet the applicable siting, setback, height, site-coverage or infrastructure provisions, a council or referral-agency response may be required before the building approval can be issued.

  1. Complete the rectification and preserve evidence

Rectification work should be completed by appropriately licensed contractors and in accordance with the approved documents. The certifier and engineer should be notified before concealed work is covered. Useful evidence can include dated photographs, delivery records, product information, concrete dockets, bolt and weld details, reinforcement photographs, survey information and inspection records. Evidence should supplement—not replace—required inspections. Changing the approved rectification details on site without review can delay certification. Proposed substitutions should be referred back to the engineer and certifier before construction proceeds.

Understand the different Queensland building forms

Form 12 — Aspect Inspection Certificate (Appointed Competent Person)

• It is used when a building certifier appoints a competent person—such as an RPEQ structural engineer—to inspect and certify a specific aspect of building work.

For example, a structural engineer might be appointed to inspect and certify that:

  • structural steelwork was installed in accordance with the approved structural drawings;

  • reinforcement or footing details comply with your design;

  • nominated structural rectification works were completed satisfactorily.

Upon the inspection and determination made by the RPEQ that the construction aligns with the provided engineering drawings, the structural engineer then issues the Form 12 to the building certifier, who uses it as supporting evidence when determining whether the relevant inspection stage is complete. The Form 12 itself does not replace the building certifier's final inspection or final certificate.

Form 15 — Compliance certificate for building design or specification

It is completed by an appointed competent person for design—commonly an RPEQ engineer for structural work—to certify that a particular design or specification complies with the nominated requirements. The building certifier can then rely on it when assessing and approving the building work.

Form 16 — Inspection certificate

Form 16 is an inspection certificate used to confirm that a particular stage of building work has been completed satisfactorily. A stage is a defined point in construction, such as the footing, slab, frame or final stage. Depending on the type of building and the stage being inspected, the Form 16 may be issued by the building certifier or, where permitted, by an appointed competent person such as a structural engineer. In simple terms, a Form 16 relates to the inspection of a whole stage of work, whereas a Form 12 is generally used when a competent person is certifying only a particular aspect of that stage. Who is permitted to issue the Form 16 depends on the building type and the inspection stage.

Form 21 — Final inspection certificate

Form 21 is the final inspection certificate issued by the building certifier when the approved building work has been completed and the certifier is satisfied that the work complies with the building development approval. It is generally used for completed Class 1a and Class 10 building work, such as houses, sheds, carports and similar structures. In simple terms, Form 16 relates to an individual inspection stage during construction, while Form 21 is issued at the end of the certification process to confirm the completed work has passed the final inspection. The Form 21 must be personally signed by the building certifier.

Finalise the records with council

Once the approval conditions, rectification and required inspections are complete, the private certifier assembles the relevant certificates and issues the applicable final documentation. The certifier then lodges the required building documentation with council.

Keep a complete copy of the approval, approved drawings, engineering documents, inspection certificates and final certificate. These records may be important for future building work, insurance, refinancing or sale of the property.
